August 22, 2014 The Industrial Board Elects Officers--New City Landowner Marshall Ramsey Becomes Secretary-Treasurer

At Wednesday's special called meeting of the Industrial Development Board of the City of Morristown, the previous officers were re-elected.


Jack Fishman will continue as chairman.
James Craine continues as vice-chairman.
Marshall Ramsey was elected as secretary-treasurer.
Anderson Smith apparently continues as "assistant" secretary treasurer.


Prior to July 1, 2014, Marshall Ramsey acted as secretary-treasurer of the IDB and signed documents on behalf of the Board although he was not qualified to serve on the Board.


He was not qualified to serve on or be an officer of the Industrial Board of the City of Morristown because he did not live in the City of Morristown nor did he own property in the City of Morristown.


Luckily, Ramsey had friends in high places.


Ramsey finally became a "legal" member of the Industrial Board on July 1, 2014, when George (MUS) McGuffin, Don "TIF" Bunch, and Wayman Skelton deeded him a city lot in Hampton West Subdivision and a few hours later the City Council appointed him to the IDB.

August 20, 2014 Industrial Board Elects Officers Today

At the Morristown Industrial Development Board meeting this morning, the IDB will be electing "officers."


The current officers are Chairman Jack Fishman, Vice-chairman James Craine, and Secretary Marshall Ramsey.


It appears that the IDB is holding an election right now because one of its current officers (Marshall Ramsey) has been serving on the Board and has been signing legal documents for the Board for nearly two years without even being qualified to serve on the Board.


The most basic qualification for IDB membership is that an individual has to be a city voter--i. e. they reside in the City or they live outside the city but own property in the city. [This came from a discussion I had with IDB Attorney Bill Foutch about IDB qualifications several months ago]


Another requirement is that an IDB member can't serve on any other city board.

Ramsey lives in the county.


When questions about Ramsey not meeting IDB qualifications were raised recently, George McGuffin (of MUS and McGuffin Law fame), Don "TIF" Bunch, and Wayman Skelton came to Ramsey's rescue. They deeded a city lot in Hampton West to Ramsey on July 1, 2014, which made Ramsey a city property owner. With that freshly-signed July 1, 2014, deed in hand, Ramsey was re-appointed by city council to the IDB on---yep---July 1, 2014.


Now to tidy things up, the IDB is electing officers so its newly-qualified member Marshall Ramsey can be officially elected as secretary to the Board and can legally sign IDB documents.


And, yes, it is possible that someone else could be elected secretary or to any of the other offices today.


Another item of interest for future posts: Ramsey was not the only member of the 16-person Industrial Board who had been serving without being qualified to serve on the Board...more on the others later.

January 30, 2013 More LeBel Testimony in Hurley Hearing: Unrevealed Conflicts and Hillbilly's Cabin

A little more video of the testimony of Real Estate Agent/Councilman Paul LeBel at the Administrative Hearing concerning fines and penalties levied by the City against developer Eddie Hurley. The City Council which was the "jury" in the hearing eventually voted 6-1 to waive all fines and penalties and move on. Video is here.
 
In a previous post, there is also a video of LeBel refusing to answer questions about his actions and possible conflicts of interest involving commercial property such as the old Berkline site where he was the real estate broker/agent and the competing commercial developments of Mr. Hurley. During later testimony, Attorney Link Gibbons asked LeBel about his abstention from voting on the Bojangles rezoning. LeBel stated there was a conflict in that situation and that he abstained because he was involved in the sale of the Bojangles property to Don Bunch at auction.
 
Gibbons then asked if there were "other" conflicts in that transaction which LeBel did not announce. LeBel's interesting response is in this video:

January 16, 2013 Massengill Springs Rezoning Approved on First Reading; Buffalo Trail Rezoning Rejected on Second Reading

MASSENGILL SPRINGS REZONING

The rezoning of the "Massengill Springs" acreage behind Bojangles on the West A.J. Highway was approved on first reading at the Morristown City Council meeting yesterday despite continued opposition from several residents of the area.  A new Food City will be the major focus of the development by BB&J.

Second reading with a public hearing will take place in February.

The vote was 4-2 in favor of the rezoning. Councilmembers Dennis Alvis, Chris Bivens, Gene Brooks, and Mayor Danny Thomas voted "yes" while Councilmembers Kay Senter and Bob Garrett voted "no." Paul LeBel was absent but had abstained from voting on Massengill Springs in September due to a conflict of interest.

The rezoning of a similar tract was rejected by council in September when the tract to be rezoned touched property of residents on Collins Street who objected and presented a petition to council that then required a 4/5 vote for approval (6 of 7 council votes).

In December, 13+ acres were sold by Luke Massengill to Dwight Frazier who then sold it to Don Bunch. Bunch then apparently combined the 13 acres with property he already owned and sold the new tract of 26+ acres to BB&J.  Since, the new tract for the proposed development no longer touches the residents of Collins Street, the residents were not able to present a petition to force a 4/5 vote for approval.

Several residents spoke out against the rezoning yesterday. As the rezoning came back to Planning Commission and to council, legal action has been threatened concerning the December deeds, plats, and other issues.

BUFFALO TRAIL

The rezoning of the property of Jimmy Sisson at 1848 Buffalo Trail was rejected on second reading yesterday. The measure to rezone the property to Intermediate Business had passed on first reading at council's December 18th meeting. The property also adjoins Medlin Street. Prior to yesterday's vote, residents along Medlin Street presented a petition to council with the required number of signatures to force a 4/5 vote for approval.

The Buffalo Trail/Medlin Street rezoning failed by a 4-2 vote. Mayor Danny Thomas and Councilmembers Gene Brooks, Chris Bivens, and Kay Senter  voted "no." Councilmembers Bob Garrett and Dennis Alvis voted "yes." Paul LeBel was absent.

June 22, 2012 Developer Pulls Masengill Springs Development from City Agenda

The Masengill Springs Development and Rezoning was pulled from the City Council agendas at the beginning of the June 19th meeting.  Developers Don Bunch and Mike Bunch are proposing moving the current Food City on West AJ Hwy across the street along with other development in the area of the old tobacco warehouse.

The proposal met with considerable opposition form residents in the North Economy Road area at a previous Planning Commission meeting where the development was sent on to city council on a 4-2 vote with one abstention.

Even though the proposal was pulled from the agenda at the start, many residents from the area were at the City Council meeting and spoke about their concerns about drainage problems and traffic problems in having an exit from the development onto North Economy Road.

There will be more discussion at a future date.
